By accessing or using SkyyNest ("we," "our," or "the Platform"), you agree to be bound by these Terms of Use. If you do not agree, you must discontinue use of the Platform immediately.

SkyyNest may update these Terms from time to time. Your continued use of the Platform constitutes acceptance of any changes.

2. About SkyyNest

SkyyNest is an educational, community, and marketplace platform designed for real estate investors. The Platform provides educational courses, workshops, and resources; property listing and posting functionality; tools for analyzing deals and market data; and investor networking and communication features.

SkyyNest is not a real estate brokerage, agent, or financial advisor. We do not represent buyers or sellers and do not participate in real estate transactions.

3. Eligibility

To use SkyyNest, you must be at least 18 years old, have the legal capacity to enter into contracts, and agree to comply with these Terms and all applicable laws.

Accounts may be suspended or terminated for violations.

4. User Accounts

You may be required to create an account to access certain features. You agree to provide accurate and complete information, maintain the security of your login credentials, notify us immediately of unauthorized access, and be responsible for all activity under your account.

SkyyNest reserves the right to refuse service or terminate accounts for any reason.

5. Educational Content Disclaimer

All educational material on SkyyNest, including courses, guides, videos, and tools, is provided for informational and educational purposes only.

SkyyNest does not provide financial, legal, tax, or investment advice; does not guarantee results, profits, or investment success; and is not responsible for decisions or actions taken based on our content.

Always consult qualified professionals before making investment decisions.

6. Property Listings & Marketplaces

Users may post properties, off-market opportunities, wholesaling assignments, or investment deals. By posting, you confirm that you are the lawful owner, hold equitable interest in an assignable contract, or are authorized to publicly advertise the property.

You may not upload MLS data unless you have the rights to do so.

SkyyNest does not verify property details or user-submitted information. Users are solely responsible for accuracy of their listings, compliance with real estate laws in their state, truthfulness and non-misleading claims, and legality of wholesaling activities.

SkyyNest is not a party to any real estate transaction and does not negotiate, arrange, or close deals.

7. Fees & Payments

SkyyNest may offer subscriptions, paid listings, course enrollments, and premium tools or features. By purchasing, you authorize SkyyNest to charge your payment method.

All fees are non-refundable unless otherwise stated. Prices may change with notice.

Payments are processed securely through third-party providers (e.g., Stripe).

8. User Conduct

You agree not to post false, misleading, or inaccurate property information; upload unauthorized MLS data; impersonate another person or entity; engage in fraud or illegal investment activity; upload harmful code, spam, or disruptive content; infringe on any copyrights or intellectual property rights; or use SkyyNest to perform unlicensed brokerage activity.

SkyyNest may remove content or suspend accounts that violate these rules.

9. Intellectual Property

All content on SkyyNest, including trademarks, logos, branding, designs, educational coursework, tools, and software, is owned by SkyyNest or its licensors.

Users may not copy, reproduce, sell, modify, distribute, or reverse-engineer any part of the Platform without written permission.

10. Platform Availability

SkyyNest does not guarantee uninterrupted service, error-free operation, or specific results or outcomes.

We may modify, suspend, or discontinue parts of the Platform at any time without liability.

11. Third-Party Services

SkyyNest may integrate with third-party services including payment processors, analytics tools, or communication platforms.

These services have their own policies, and SkyyNest is not responsible for their actions or content.

12. Limitation of Liability

To the fullest extent permitted by law, SkyyNest is not liable for losses, damages, or claims resulting from your use of the Platform. We are not responsible for real estate transactions, investment outcomes, or decisions based on educational content.

We provide the Platform "as is" without warranties of any kind. You assume full responsibility for all investment decisions and any real estate dealings facilitated outside the Platform.

13. Indemnification

You agree to indemnify and hold SkyyNest harmless from claims, losses, damages, liabilities, and legal fees arising from your use of the Platform, property postings, or violation of these Terms.

14. Termination

SkyyNest may suspend or terminate your account at any time for violating these Terms, posting fraudulent or misleading listings, abusive or unlawful behavior, payment failures, or security concerns.

Upon termination, your access to paid or free features may end immediately.

15. Governing Law

These Terms are governed by the laws of the State of Maryland, USA, without regard to conflict-of-law rules.

Any disputes shall be resolved in the courts of Maryland.
