SkyyNest allows users to post properties, off-market opportunities, wholesale assignments, and real estate investment deals. This Posting & Listing Policy outlines what you can post, the requirements you must meet, and the legal responsibilities involved.

By posting on SkyyNest, you agree to comply with this policy and all applicable local, state, and federal real estate laws.

2. What You Can Post

Users may post the following types of properties and opportunities:

a. Properties You Own: If you are the legal owner of a property and wish to sell it, you may post it on SkyyNest.

b. Off-Market Opportunities: Properties that are not listed on the MLS but are available for sale or investment.

c. Wholesale Assignment Deals: If you hold an assignable purchase contract and have equitable interest in a property, you may post it as an assignment opportunity.

d. FSBO (For Sale By Owner) Listings: If you are the property owner selling directly without a real estate agent.

e. Investment Opportunities: Joint ventures, syndications, or other real estate investment opportunities (subject to securities laws).

All postings must comply with real estate laws in your jurisdiction, including wholesaling regulations, disclosure requirements, and advertising rules.

3. Requirements for Posting

To post a property or investment opportunity on SkyyNest, you must meet the following requirements:

a. Legal Authorization: You must be the property owner, hold an assignable contract with equitable interest, be authorized by the owner to publicly advertise the property, or hold a valid real estate license (if required in your state).

b. Accurate Information: All property details must be accurate, truthful, and not misleading. This includes price, address, property condition, ownership status, and any liens or encumbrances.

c. Compliance with Wholesaling Laws: If you are posting a wholesale assignment, you must comply with your state's wholesaling laws. Some states require disclosure that you are not the owner, prohibit certain advertising language, or require a real estate license. It is your responsibility to ensure compliance.

d. No Unauthorized MLS Data: Do not upload or post MLS data unless you have explicit authorization from the MLS or are a licensed agent with the right to use that data.

e. Truthful Representation: Do not misrepresent your relationship to the property, your ownership status, or the terms of the deal.

4. Prohibited Listings

The following types of listings are strictly prohibited and will be removed:

• Properties you do not own or control: You cannot post someone else's property without permission.

• Fraudulent or misleading listings: Any listing that contains false information or is designed to deceive buyers.

• Stolen or unauthorized MLS data: Listings copied from the MLS without authorization.

• Listings that violate fair housing laws: Any discriminatory language or practices based on race, religion, gender, disability, familial status, or national origin.

• Illegal transactions: Listings that involve illegal activity, such as unlicensed brokerage, fraud, or tax evasion schemes.

• Duplicate or spam listings: Repeatedly posting the same property to manipulate visibility.

5. SkyyNest's Role

SkyyNest is a platform that connects real estate investors, buyers, and sellers. However, SkyyNest is NOT a real estate broker, agent, or financial advisor.

SkyyNest does NOT:

• Verify the accuracy of property listings or user-submitted information

• Guarantee the legality of any transaction

• Act as a party to any real estate contract or negotiation

• Provide legal, financial, or investment advice

Users are solely responsible for their listings, transactions, and compliance with all applicable laws. SkyyNest provides the platform but does not participate in deals.

6. User Responsibility & Liability

By posting on SkyyNest, you represent and warrant that:

• You have the legal right to post the property or opportunity

• All information provided is accurate and not misleading

• You will comply with all local, state, and federal real estate laws

• You are solely responsible for any disputes, claims, or legal issues arising from your listing

You agree to indemnify and hold SkyyNest harmless from any claims, damages, or legal actions resulting from your postings or transactions.

7. Listing Removal & Account Suspension

SkyyNest reserves the right to remove any listing or suspend any user account if:

• The listing violates this Posting & Listing Policy

• The listing is fraudulent, misleading, or inaccurate

• The user does not have legal authorization to post the property

• The listing violates fair housing laws or other regulations

• The user engages in spamming, manipulation, or abusive behavior

• We receive a valid complaint or legal request

Repeat offenders may be permanently banned from the platform.

8. Reporting Violations

If you believe a listing violates this policy or contains fraudulent information, please report it immediately by using the platform's reporting tools or contacting us at contact@skyynest.com.

Provide as much detail as possible, including links, screenshots, and descriptions of the violation.

9. Privacy & Contact Information

When you post a listing, you may choose to display your contact information publicly. Be aware that this information will be visible to other users on the platform.

SkyyNest is not responsible for unsolicited communications you receive as a result of posting your contact information.

10. Changes to This Policy

SkyyNest may update this Posting & Listing Policy from time to time to reflect changes in our platform, legal requirements, or industry standards.

Your continued use of the platform after changes are posted constitutes acceptance of the updated policy.
